Private, public and ad judicia power of attorney — the difference
A PRIVATE power of attorney ("procuração particular", what this tool generates) is a simple instrument, signed directly by the parties, for everyday civil acts. A PUBLIC power of attorney must be drawn up before a Brazilian notary ("cartório") — required by law for specific acts, such as selling real estate; no online tool replaces that step. An AD JUDICIA power of attorney grants powers to represent someone in a court case, with formal requirements from Brazil's Code of Civil Procedure (normally drafted by a lawyer) — also outside this tool's scope.
Notarizing or digitally signing
The generated PDF is a valid private instrument as a template, but several institutions — banks especially — only accept a private power of attorney with the signature notarized ("firma reconhecida em cartório") or with a valid electronic signature. A modern alternative, without leaving home: after downloading the PDF, access Brazil's gov.br Document Signer (assinador.iti.br) and sign with your gov.br Digital Identity — it's free and carries legal validity as an advanced electronic signature (Law 14,063/2020). If the power of attorney has witnesses, each one can access the same gov.br Signer and add their own digital signature to the PDF already signed by the grantor, one after another, skipping notarization on paper entirely. Confirm beforehand with the receiving institution which of the two forms it accepts.
Predefined powers and additional powers
Powers checked from the list become ready-made, formally worded clauses in the body of the power of attorney — no need to draft legal language from scratch. The free-text field complements the list for a specific power that doesn't fit the predefined options; each line typed becomes its own additional clause.
Fixed or indefinite term
A fixed term (with a start and end date) limits the mandate's validity to a specific period — recommended when the power is for a one-off matter. An indefinite term keeps the mandate valid until expressly revoked — more common when the grantee needs to keep representing the grantor for an unspecified length of time.
Where your data stays
The entire power of attorney is assembled in your browser — the data you type (including both parties' CPF, RG and address) and the signature you draw never leave it or reach any server. If you check "remember my data", only the GRANTOR's data is saved to this browser's local storage (never synced or sent anywhere) until you clear it.
